Metrowatt Power M Giveaway Campaign Terms & Conditions 

Introduction

1. Participation in this Competition is governed by these terms and conditions (the “Rules”).
2. Applicants are encouraged to review the Rules before entering the Competition and acknowledge that they have been given an appropriate opportunity to do so and that they understand and accept these rules.This Competition is operated by Metrowatt Proprietary Limited (“Metrowatt”) 
3. Participation in the Competition constitutes acceptance of these Rules and Applicants agree to abide by these Rules.

By participating in this Competition, Applicants agree to the rules set out below

• This Competition is open to anyone who is 18 years and older and is a legal citizen of the Republic of South Africa. Only natural persons will be allowed to enter and no legal entities.
  • The applicant must be the owner of the property for address specified in the application or a tenant thereof. The following people shall not be eligible to participate in this Campaign:
    • An existing customer applying for the same address with an existing Metrowatt installation.Employees, directors, partners, promotional and advertising agents,  merchandisers, or consultants of Metrowatt or Myriad Group.;Spouse, life partner, parent, child, brother, sister, business partner or associate of any of the persons specified above; People who are not legal residents and/or legal citizens of the Republic of South Africa; andPersons under the age of 18 years.
  The Campaign shall commence on 15th February 2024 and end on 31^st May 2024.

Mechanics of Campaign

• To participate in this Campaign, Participants must adhere to the following:
  • Participants are required to complete the quoting process on www.metrowatt.co.za either via clicking on links provided in marketing collateral or directly via the website when they select “Get Quote” tab on the homepage.
  • Only the first application per specified address will be entered into the campaign.
  • All customers will be contacted by our expert solar consultants to assess their  solar solution needs and endeavour to finalise a quotation.
  • The Participant has no authority to represent or bind Metrowatt to their referral parties.
  • We introduce Competitions such as these in good faith and expect the same good faith in return. 
  • Three prizes will be awarded and three winners will be drawn by a representative of Metrowatt. All Prize Draws will be officiated by a senior representative.

Campaign Draw:

• There will be three draws for three monthly prizes. Draws will be held within 5 business days of the closing period for each monthly prize. The periods will run from: 
  • 15 February 2024 until 31 March 2024;
  • 1 April 2024 until 30  April 2024; and 
  • 1 May 2024 until 31 May 2024.
    • The first quote application per specified address will qualify for the draw in the month pertaining.Your quote application will only be applicable to the draw for the month in which you applied.All winners will be notified of the outcome of each prize draw via a telephonic call or email.All prizes are tax-freeA tax certificate may not be issued for competition entries.Prizes will be donated back to Metrowatt if they are not claimed within 24 hours of the winner being notified.In the event of a dispute the decision of the auditing firm will be final and no correspondence will be entered into regarding the result.
  • Participation in the competition and acceptance of any prize (if you are the winner) is subject to acceptance of the terms & conditions set out.

The Prizes:

• 3 Huawei Power M inverter with 5kWh battery. One draw per month as set out in the competition draw rules. 

General

• An “Applicant” is a party that has completed the quotation process with Metrowatt for a solar solution. 
  • Only the first quote application for the specified property address will be considered.The prize is not transferable, and no substitution of prizes is permitted.   The prize will not be handed/awarded to a third party, but only to the verified prize winner.By entering this Competition, you authorise Metrowatt to store and use (not share) personal information for communication or statistical purposes. You are entitled to decline any marketing communication by email by clicking “unsubscribe” located at the end of the mailer. Any personal data submitted by you will be used solely in accordance with current South African data protection legislation and Metrowatt’s privacy policy which is available on our website. Applicants may be required to take part in publicity campaigns for broadcast or publishing purposes. Applicants shall always be entitled to decline the above request. Applicants that take part in any publicity campaigns will not be entitled to any payment or other remuneration for such publicity campaign or otherwise. All publicity and other materials will be the sole property of Metrowatt. Nothing in these Rules is intended to, or must be understood to, unlawfully restrict, limit, or avoid any rights or obligations, as the case may be, created for either the Participant or the Metrowatt solar consultant in terms of the Consumer Protection Act, 68 of 2008 ("CPA"). All Applicants participate entirely at their own risk. By reading and accepting these Rules, each Applicant gives consent to these risks and hereby indemnifies and holds harmless the Metrowatt solar consultant, their directors, employees and agents of any and all liability pertaining to any damage, cost, injuries and losses of whatever nature sustained as a result of their participation in the Competition and related events and activities, save where such damage, cost, injuries and losses are sustained as a result of the gross negligence or wilful misconduct of any of the Metrowatt employees mentioned above.Metrowatt, their directors, employees, agents and distributors accept no responsibility and they will not, in any circumstances, be liable to compensate the Applicants, or accept any liability for: (a) any inability by the Applicants to use the prize in part or at all; (b) the lack of quality or any other aspect of any service which is or should be provided at any venue(s) in relation to the prize; or (c) any personal loss or injury occurring at any venue(s) arising, directly or indirectly, out of the use of the prize. Metrowatt, their directors, employees, agents, and distributors are not responsible for any misrepresentation (whether written or verbal) in respect of any prize nor in respect of any warranties or undertakings given by any person.Metrowatt reserves the right to terminate or extend the Competition at any time. In the event of such termination or extension, all Applicants agree to waive (i.e. give up) any rights that they may have in terms of the Campaign and acknowledge that they will have no recourse against Metrowatt, its advertising agencies, advisors, suppliers and nominated agents.By entering the Competition, Applicants acknowledge that the Campaign will be managed in accordance with the provisions of the CPA. Applicants undertake to expeditiously do all things necessary to enable Metrowatt  to comply with their obligations under the CPA including, but not limited to providing such personal information as may be required to facilitate handing over the prize to the Applicant. Should any applicant refuse or be unable to comply with this requirement, the applicant shall be deemed to have forfeited the prize. Notwithstanding anything to the contrary contained in these Rules, Metrowatt  reserves the right to amend, modify, change, postpone suspend or cancel this Campaign, the Rules, and any prize (which has not yet been allocated), or any aspect thereof, without notice at any time, for any reason which Metrowatt may deem necessary. At the end of the Campaign for whatsoever reason, all Metrowatt obligations regarding the Campaign as well as in regard to the prizes shall cease to exist.Applicants and/or Customers of Metrowatt that have violated and/or breached Metrowatt’s terms and conditions and/or policies are disqualified from participating and/or receiving prizes.These Rules shall be governed by and interpreted according to the laws of the Republic of South Africa and any Applicant and Metrowatt consent to the non-exclusive jurisdiction of the High Court of South Africa.
